Since the decision in the case of Siemens Building Technologies, Inc. v. Iberville Parish School Board, No. 64,935, Division “B”, in which the Court found, in our favor, an energy efficiency contract invalid, Unglesby & Marionneaux has been on the forefront of the legal issues addressing the validity of energy efficiency contracts and their compliance with the statutorily mandated requirements set forth in Louisiana Revised Statute 33:4547.1.

This decision was the first of its kind finding that stipulated savings clauses are invalid and not compliant with Louisiana Revised Statute 33:4547.1. In effect, this decision has put more than one (1) billion dollars of contracts at risk throughout the state of Louisiana.
